  1. Registration in the Store takes place based on a correctly completed registration form, in which the Client provides the necessary identification data (first name, last name), e-mail address and password; accepted, current Store Regulations and a declaration of consent to the processing of personal data to the extent necessary for the proper execution of Client Orders. Registration of an Individual Client Account can also be done by checking the appropriate box during the Order placement process. An e-mail confirming the creation of the Account will be sent to the Client's e-mail address provided in the registration form. Upon receipt of the registration confirmation message, an agreement for maintaining the Account is concluded between the Individual Client and the Store.
  2. After registering in the Store, logging in takes place using the data provided in the registration form or changed based on a subsequent Client request.
  3. To delete the Client's account from the Store (termination of the agreement), an electronic message with a request to delete the account should be sent to the e-mail address: kontakt@easycandle.pl providing the Client's identification data currently registered in the Store. The above does not apply to situations where the Store is in the process of fulfilling an Order placed by the Client. In such a case, the termination of the agreement will take effect upon the fulfillment of the said Order.
  4. The Store allows placing Orders without the need to register and log in to the Store. For this purpose, the Client is obliged to complete an electronic form each time during the Order placement process by entering the data required by the Store necessary for their identification and the conclusion and execution of the sales agreement (first name and last name, e-mail address, telephone number - optional, delivery address). The Client is obliged to accept the current Regulations along with a declaration of consent to the processing of personal data for the needs of the Order. Lack of registration in the Store means not having a Client Account, which allows access to automatic Order tracking.
  5. Clients who are Entrepreneurs with consumer rights wishing to exercise these rights are obliged to provide their NIP (tax identification number) when placing an order while logged into an individual Client account or using the Order placement form without logging in.

B. WHOLESALE CLIENTS:

  1. Registration in the Store is free, but mandatory for Clients who wish to place Orders as Wholesale Clients. In such a case, the Store does not allow placing Orders without the need to register and log in to the Store.
  2. To be able to make purchases in the Store as a Wholesale Client, i.e., to obtain individual purchasing conditions, the following conditions must be met:

    • register a dedicated Wholesale Client account in the store,
    • place Orders using the option of logging into an individual Wholesale Client account.
  3. After meeting the conditions specified in point 7 above, the Store will, within 7 days from the conclusion of the agreement with the wholesale Client, confirm the registration of the dedicated account in the Store and provide access to the Store's wholesale offer.
  4. After logging into the Wholesale Client Account, this Client will see the wholesale offer made available to them, as well as the relevant prices and delivery conditions.
  5. Payment for Orders with the option of logging in as a Wholesale Client will be made based on invoices issued by the Store. The Wholesale Client cannot pay for the order by using online payments.
  6. The Wholesale Client has the right to make purchases also without logging into the Account, however, in such a case, they will place Orders under the same conditions as retail Clients.
  7. To delete a Client account from the Store, both Individual Account and Wholesale Account (termination of the agreement), an electronic message with a request to delete the account should be sent to the e-mail address: kontakt@easycandle.pl providing the Client's identification data currently registered in the Store or select the appropriate option in the account settings. The above does not apply to situations where the Store is in the process of fulfilling an Order placed by the Client. In such a case, the termination of the agreement will take effect upon the fulfillment of the said Order.

§ 5 ORDERS

  1. Information about the available assortment in the Store constitutes an invitation to conclude a contract within the meaning of art. 71 of the Civil Code.
  2. The Client, by placing an Order, makes an invitation to conclude a sales agreement for the ordered Products in the Store. The process of ordering a Product begins with the confirmation of the performance characteristics via the Product Page. The Client is informed about the estimated Order fulfillment time, product availability, price, and payment methods, as well as possible delivery options. To deliver the product, the Client is obliged to provide their address data or verify them if an account has been previously registered. Before placing an order (by using the "Order and pay" button), the Client confirms that they have read these Regulations along with consent to the processing of personal data for the needs of the Order.
  3. The confirmation of acceptance of the Order sent by the Store to the e-mail address provided by the Client constitutes a statement of acceptance of the invitation referred to above. If, before confirming the placement of the Order (the "Order and pay" button), the Client stops using the given service and leaves the Store, the agreement will not be concluded.
  4. A Client making a purchase as an entrepreneur is obliged to provide their NIP (tax identification number) when placing an Order; otherwise, it is assumed that they are purchasing as a Consumer.
  5. The assessment of whether a Client who is an entrepreneur registered in the CEIDG register has the status of an Entrepreneur with consumer rights is made by the Store on a case-by-case basis and based on any statements made by the Client during the ordering of Products.
  6. To place an Order, the Client is obliged to choose, from those available in the Store: ordered products, delivery method, payment method (not available for wholesale clients), and specify the delivery address. The choice is made by: selecting a product and adding it to the Basket.
  7. The Client can select an unlimited number of products for the Order from the quantity of a given Product available for Orders, and after proceeding to the Basket, they will receive a summary of the selected Products. If the quantity of Products is limited, the Store will indicate this information on the product page.
  8. In the event of unavailability of a given Product, a wholesale Client may reserve the Product by sending an e-mail to the Seller requesting to reserve the Product with the desired quantity and expected shipping date, or by using the reservation option by proceeding to the Product ordering path with the proviso that selecting the Product order icon then means reserving that Product under the conditions specified in this paragraph. The Store will respond to the wholesale Client by e-mail within 3 business days, stating whether the reservation can be fulfilled (confirming or rejecting it), or possibly providing other delivery conditions (quantity, date) and asking the Client whether they accept the reservation after the changes. If acceptance is not expressed within 7 days, the reservation expires.
  9. In case of unavailability of Products covered by the Order in the warehouse, from the Store's suppliers or for other reasons and inability to fulfill the Client's Order, the Store will notify the Client of this fact no later than within 14 (fourteen) days, counting from the date of placing the Order. In such a case, the Client has the right to decide whether they agree to the fulfillment of the Order within the period proposed by the Store or withdraw from the agreement. In case of inability to fulfill part of the Order, as mentioned above, the Client is informed about the status of the Order and decides on how it will be fulfilled. The Client has the option to choose between:
    • partial fulfillment - the Client's choice of this option results in the fulfillment of the Order concerning only the available Products;
    • cancellation of the entire Order (withdrawal).

In the event of withdrawal from the contract, the Store will return the amount paid as the price to the Customer. The notification will be sent to the e-mail address indicated by the Customer in the Order form or registration form. If no decision is made within 7 (seven) days of the notification, the Order will be cancelled for unavailable Products.

§ 6 PRICE OF PRODUCTS AND FORMS OF PAYMENT

  1. The price given for each Product is binding at the moment the Customer places the Order. Prices of goods posted on the Store's website include VAT (if charged due to the place of delivery of the Goods) and do not include delivery costs. The price may include an individually calculated discount or rebate, assigned to the Customer in an automated manner - information about this is included in the Order summary.
  2. Delivery of goods takes place in the following variants offered in the Store:
    • via courier company,
    • via InPost parcel lockers,
    • via the "Orlen Paczka" service provided by "RUCH" S.A. (with its registered office: ul. Information about delivery costs is available during the ordering process before placing such an Order. A wholesale customer may have different delivery methods or delivery costs reserved in the agreement concluded with them.

  1. Delivery costs will be included in the prices of the Products depending on the ordered goods and the Customer's choice of delivery method, when placing the Order.
  2. The Seller provides the Customer with the following payment methods for Products:
    • Electronic payments and payment card payments via the Przelewy24.pl service - payment processing is carried out by PayPro Spółka Akcyjna with its registered office in Poznań at ul. 3. Within the above payment mechanism, the Seller provides the Customer, among others, with the following forms of payment for Products:
    • Visa
    • Visa Electron
    • Mastercard
    • MasterCard Electronic
    • Maestro
  4. If an Order is placed and a payment option other than on delivery is chosen and the payment for that Order is not credited within 7 (seven) days, the Order will be cancelled. After three (3) business days from placing the Order, if no payment has been credited, the Customer will receive a payment reminder at the e-mail address provided.
  5. The Order will be issued within the time specified in the Order confirmation and previously accepted by the Customer, but no later than 30 (thirty) days from the date of concluding the agreement. On the product page, the Store provides the estimated shipping time for the Order.
  6. A wholesale customer cannot pay for an Order using the above methods when logged into their Wholesale Customer account. In their case, payment is made based on pro-forma invoices issued by the Store with deferred payment terms. The invoice is sent within 1 business day to the wholesale customer's email provided during registration. The condition for shipping the Goods is payment of the invoice.
  7. For some Products or upon reaching a certain Order value, the delivery cost is borne by the Store, of which the Customer is informed each time before placing the Order.
  8. The Store may announce promotions for Products on its website. In such a case, if the Customer has a discount coupon, they can use it - within the framework of the current promotion - by entering the discount code after proceeding to the shopping cart and clicking "Add". The Store's system, after verifying the discount code, will take it into account in the Order settlement, which will be automatically reflected by changing the Order price or adding other discount options depending on the type of discount coupon.
  9. In the event of a return shipment to the Seller due to non-collection of the shipment (regardless of the chosen delivery method), it will be stored at the expense and risk of the Customer at the Seller's premises for a period of 7 days. In such a case, the Seller will call on the Customer to collect the Order and indicate the collection deadline. After this period, the Seller reserves the right to withdraw from the contract, dispose of such a shipment at the Customer's expense, and pursue the costs of returning the shipment, its storage costs, and appropriate compensation.

§ 7 COMPLAINTS

  1. The Store is obliged to deliver a Product that is compliant with the contract and free of defects, and to duly perform the agreed services.
  2. In the event of a defect in the delivered goods, the Customer may, at their choice, exercise warranty rights, if a warranty has been granted, and rights available to them from the Seller under statutory warranty. Warranty rights and rights under statutory warranty are independent of each other.
  3. The Store is liable for the non-conformity of the goods with the contract existing at the time of delivery and revealed within two years from that moment, unless the usability period of the Product, specified by the Store, its legal predecessors, or persons acting on their behalf, is longer. It is presumed that the non-conformity of the goods with the contract, which became apparent before the expiry of two years from the moment of delivery of the Product, existed at the time of its delivery, unless proven otherwise or if this presumption cannot be reconciled with the nature of the goods or the nature of the non-conformity of the goods with the contract.
  4. In the case of contracts concluded with Consumers and Entrepreneurs with consumer rights, the Store is liable under warranty and/or contractual liability for the services rendered. This liability is excluded for Customers with other statuses.
  5. A Product is compliant with the contract if its features, in particular:
    • Features such as description, type, quantity, quality, completeness, and functionality;
    • Suitability for a specific purpose for which the Customer needs it, of which the Customer informed the Store at the latest at the time of concluding the contract, and which the Store accepted.
    • Appropriateness and suitability for purposes for which this type of Product is usually used, taking into account applicable legal provisions, technical standards, or good practices;
    • Quantity and characteristics, including durability and safety, that are typical for this type of Product and which the Customer can reasonably expect, considering the nature of the Product;
    • Delivery method, including packaging, accessories, and instructions, the delivery of which the Customer can reasonably expect;
    • Quality that must correspond to the same quality as the sample or model that the Store made available to the Customer before concluding the contract, and correspond to the description of such a sample or model.
  6. In the event of a defect in the delivered product or rendered services, the Customer may file a complaint and inform the Store about the observed irregularities and document them in order to verify the concerns. A complaint may be submitted electronically or in writing to the Store's address.
  7. The Store undertakes to consider the complaint within 14 days from the date of its submission and to inform the Customer about the resolution and further proceedings in writing or via e-mail to the e-mail address provided in the complaint or on another durable medium.
  8. In the event of non-conformity of the Product with the contract, the Customer may demand its repair or replacement. The Store may replace the goods if the Customer demanded its repair or repair it if the Customer demanded its replacement only if ensuring the conformity of the goods with the contract in the manner originally chosen by the Customer is impossible or would incur excessive costs. If repair and replacement are impossible or would incur excessive costs for the entrepreneur, they may refuse to bring the goods into conformity with the contract. In such a case, the Customer may submit a declaration of price reduction or withdrawal from the contract. When assessing the excessiveness of costs for the Store, all circumstances of the case are taken into account, in particular the significance of the non-conformity of the Product with the contract, the value of the Product compliant with the contract, and excessive inconvenience for the Customer resulting from the change in the method of bringing the Product into conformity with the contract.
  9. The Customer may submit a declaration of price reduction or withdrawal from the contract if the Product is non-compliant with the contract when:
      • The Store refused to bring the Product into conformity with the contract;
      • The Store did not bring the Product into conformity with the contract;
      • The non-conformity of the Product with the contract continues, despite the Store's attempts to bring the Product into conformity with the contract;
      • The non-conformity of the Product with the contract is significant enough to justify an immediate price reduction or withdrawal from the contract;
      • It is clear from the Store's statement or circumstances that it will not bring the Product into conformity with the contract within a reasonable time or without undue inconvenience to the Customer.
  10. The reduced price must remain in such a proportion to the price resulting from the contract as the value of the non-compliant goods is to the value of the compliant goods. The Store returns the amounts due as a result of exercising the right to a price reduction immediately, no later than within 14 days from the date of receipt of the Customer's declaration of a price reduction.
  11. The Customer cannot withdraw from the contract if the non-conformity of the goods with the contract is insignificant. It is presumed that the non-conformity of the goods with the contract is significant.
  12. The Store is obliged to perform repair or replacement within a reasonable time from the moment it was informed by the Customer about the lack of conformity with the contract, and without undue inconvenience to the Customer, taking into account the specifics of the goods and the purpose for which the Customer acquired them. The costs of repair or replacement, including in particular the costs of postal charges, transport, labor and materials, are borne by the Store. The Customer is obliged to make the Product subject to repair or replacement available to the Store. The Store collects the goods from the Customer at its own expense. The Store does not accept cash-on-delivery shipments. In some cases, it is not necessary to send the advertised Product, and the Store may limit itself to examining photos provided by the Customer, of which it will inform the Customer after receiving the complaint notification.
  13. The Customer is not obliged to pay for ordinary use of the goods that were subsequently replaced.
  14. If the lack of conformity with the contract concerns only some of the goods delivered under the contract, the Customer may withdraw from the contract only in relation to these goods, as well as in relation to other goods purchased by the Customer together with the non-conforming goods, if it cannot be reasonably expected that the Customer would agree to keep only the conforming goods.
  15. In the event of withdrawal from the contract, the Customer shall immediately return the goods to the Store at the Store's expense. The Store shall return the price to the Customer without undue delay, no later than within 14 days from the date of receipt of the goods or proof of their return, using the same method of payment as used by the Customer, unless the Customer has expressly agreed to a different method of return which does not incur any costs for them.
  16. In the event of a dispute between the Store and the Customer regarding the justification of refusing to accept a complaint, the Customer, being a Consumer, has the right to use out-of-court methods of resolving complaints and pursuing claims. The Customer may use mediation or amicable court proceedings by submitting an appropriate form – an application for mediation or an application for consideration of the case before an arbitration court – to the institution before which the proceedings will be conducted. A list of sample institutions with contact details is available on the website www.uokik.gov.pl. In addition, at http://ec.europa.eu/consumers/odr, the Consumer has access to resolving consumer disputes electronically via the EU online platform (ODR platform). This right does not apply to an Entrepreneur with consumer rights.

§ 8 RIGHT OF WITHDRAWAL FROM THE CONTRACT

  1. A Customer who is a Consumer or an Entrepreneur with consumer rights may withdraw from the contract without giving a reason within 14 days from the date of receipt of the shipment. They should then submit a declaration of withdrawal from the contract and return the Goods to the Store. To submit a declaration of withdrawal, the withdrawal form attached to the Regulations can be used. The deadline is considered met if the Consumer or Entrepreneur with consumer rights sends the declaration of withdrawal in writing to the Seller's address or electronically to the e-mail: kontakt@easycandle.pl, no later than on the last day of the 14-day period. Upon receipt of the declaration of withdrawal electronically to the aforementioned e-mail or postal address, the Seller will immediately confirm its receipt by sending information to the withdrawing party's e-mail address. A declaration of withdrawal from the contract submitted after the aforementioned deadline does not produce legal effects.
  2. Goods should be returned in an unchanged and complete condition, without signs of use, unless the change was necessary within the limits of ordinary management, i.e., the Consumer or Entrepreneur with consumer rights should handle the Goods with a view to the necessity of their possible, later return. They are responsible for the decrease in the value of the item resulting from using it in a way that exceeds what is necessary to ascertain the nature, characteristics, and functioning of the item. If the returned Goods are incomplete or show signs of use exceeding ordinary management of the item, the Store reserves the right to refuse to accept the shipment or reduce the refunded amount by the equivalent of the damaged goods, at the Store's discretion.
  3. The right of a Consumer or Entrepreneur with consumer rights to withdraw from the contract does not apply if the subject of the Order is, among others, a contract:
      • in which the subject of the service is non-prefabricated goods, manufactured according to the consumer's specifications or serving to satisfy their individualized needs;
      • in which the subject of the service is goods delivered in a sealed package, which after opening the package cannot be returned due to health protection or hygienic reasons, if the package was opened after delivery;
      • in which the subject of the service are goods that, after delivery, due to their nature, become inseparably combined with other items;
  4. Returned Goods should be sent back no later than 14 days from withdrawal from the contract along with a declaration of withdrawal to the Store's warehouse address, i.e. ul. Polna 1A, 21-470 Krzywda. The Consumer or Entrepreneur with consumer rights bears only the direct costs of returning the Product to the Store (shipping costs).
  5. In the event of withdrawal from the contract, all payments made by the Consumer or Entrepreneur with consumer rights, including delivery costs, will be transferred to the Consumer or Entrepreneur with consumer rights immediately, but no later than within 14 days from the date of receipt by the Store of the declaration of withdrawal from the contract.
  6. Payments made by payment card or electronic transfer will be refunded to the bank account from which the payment was made, unless the Customer explicitly submits a different refund instruction that does not generate additional costs for them before the refund (e.g., in the declaration of withdrawal).
  7. The Store may withhold the refund of payments received from the Buyer until it receives the ordered goods back from the Buyer or the Buyer provides proof of their return, whichever occurs first.

§ 9 PERSONAL DATA PROTECTION

Provisions concerning the protection of Customer personal data by the Seller are set out in the Privacy and Cookies Policy posted on the Store's Website.

§ 10 COPYRIGHT

The Regulations and all content placed in the Store, including photos and descriptions, are subject to copyright within the meaning of the Act of February 4, 1994 on copyright and related rights and are subject to legal protection. Any copying, reproduction, dissemination, or creation of derivative works thereof, in whole or in part, by any methods, devices, techniques, without the written consent of the Store is prohibited.

§ 11 FINAL PROVISIONS

  1. For every Product sold by the Store, a VAT invoice or another settlement document compliant with applicable tax regulations is issued. The VAT invoice is delivered electronically to the email address provided by the Customer or in traditional form along with the delivery of the goods. Acceptance of the Regulations constitutes consent to sending invoices electronically.
  2. The applicable law is Polish law. Disputes arising between the Customer and the Seller will be settled by the court competent for the Seller's registered office, with the proviso that, in relation to Consumers, these disputes will be heard by the court competent according to the provisions of civil procedure. These Regulations are subject to Polish law and will be interpreted in accordance therewith. These Regulations do not limit any consumer protection rights that the user may be entitled to under mandatory provisions in their country of residence.
  3. The Seller reserves the right to change the Regulations. The Seller will notify registered Customers of changes to the Regulations by email, with the right to terminate the agreement within 14 days. Changes to the Regulations come into effect 14 days after notification. Orders placed before the effective date of changes to these Regulations are processed based on the provisions in force on the date of placing the Order.
